1. Payment and Delivery

All transactions are processed through a secure third-party payment gateway. Payment is required in full at the time of purchase. Upon successful payment, digital products, including but not limited to sheet music, accompaniment videos, model teaching videos, soundtracks, and worksheets, will be made available via download link or digital access.

Due to the nature of digital products, delivery is considered complete once access has been granted.

All sales are final.

2. No Refund Policy

All sales of digital products are final. Because digital content is delivered immediately upon purchase, refunds, exchanges, or cancellations will not be provided under any circumstances.

Customers are responsible for reviewing product descriptions carefully before completing a purchase.

3. License and Permitted Use

The license does not permit:

• Use by multiple teachers within a studio or school without proper licensing

If you wish to use these materials in a studio, school, or organization involving multiple teachers, you must contact us to obtain an appropriate group or site license.

4. User Responsibilities

Users agree not to reproduce, duplicate, copy, modify, distribute, display, publish, license, create derivative works from, or exploit any portion of the digital content without prior written permission.

Users agree to comply with all applicable laws when using the materials.

Violation of these terms may result in immediate termination of access without refund.

5. Intellectual Property

All content, including but not limited to sheet music, instructional videos, accompaniment tracks, teaching materials, graphics, text, branding, and curriculum design, is the exclusive property of Music Circle Publishing and is protected by international copyright and intellectual property laws.

Unauthorized use, reproduction, or distribution of any materials may result in legal action.

6. Monitoring and Enforcement

We reserve the right to monitor the use of our digital content and investigate suspected violations of these terms.

We reserve the right to pursue any remedies available under law, including legal action, in cases of unauthorized use, redistribution, or intellectual property infringement.

7. Disclaimer of Warranties

All products and materials are provided “as is” without warranties of any kind, either express or implied.

We do not guarantee specific educational results, business outcomes, or performance results from the use of our materials.

We do not guarantee uninterrupted or error-free access to digital content and are not responsible for compatibility issues with individual devices or software.

8. Limitation of Liability

To the fullest extent permitted by law, Music Circle Publishing shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the use or inability to use our materials.

Our total liability, under any circumstance, shall not exceed the amount paid for the product purchased.

9. Privacy

We collect personal information, such as name and email address, solely for the purpose of processing orders and delivering purchased products.

We do not sell, rent, or share customer data with third parties for marketing purposes.

By making a purchase, you consent to the collection and use of your information for order fulfillment and customer service.

10. Termination of Access

We reserve the right to offer additional licensing tiers, including but not limited to individual teacher licenses, studio licenses, school licenses, and organizational or district licenses. Separate pricing, permissions, and contractual agreements may apply to these licensing categories. The purchase of an individual license does not grant rights applicable to studio-wide, multi-teacher, or institutional use unless expressly authorized in writing.

15. Prohibition of Curriculum Replication

The materials, including but not limited to curriculum structure, teaching methodology, sequencing, lesson framework, worksheets, videos, and supporting resources, may not be incorporated into another curriculum, training system, commercial program, or derivative educational product without prior written permission from Music Circle Publishing.

Users may not modify, repackage, rebrand, or redistribute any portion of the curriculum as part of another instructional system or commercial offering.

16. Trademark Protection

All trademarks, service marks, logos, curriculum names, brand identifiers, and related branding elements are the property of Music Circle Publishing. Unauthorized use of any trademarks or brand elements, including use in advertising, promotional materials, websites, or derivative products, is strictly prohibited without prior written consent.

17. Anti-Sharing and Account Security

Users are prohibited from sharing download links, digital files, login credentials, or access to purchased materials with any other individual or entity.

Each purchase grants access solely to the licensed user. Unauthorized file sharing, distribution through shared drives, cloud platforms, or internal studio systems without proper licensing constitutes a violation of these Terms and may result in immediate termination of access without refund.

18. Educational Results Disclaimer

While our curriculum and materials are designed to support effective music instruction, individual results may vary based on implementation, teaching methods, student engagement, and other external factors.

We do not guarantee specific educational outcomes, performance results, examination results, or business growth outcomes from the use of our materials.

19. Subscription and Membership Terms 

We offer subscription-based services, membership programs, or recurring access plans that provide access to digital curriculum materials, instructional resources, exclusive content, or other educational offerings.

Subscription fees are billed on a recurring basis according to the billing cycle disclosed at the time of enrollment. By enrolling in a subscription program, you authorize us to charge the applicable recurring fees to your designated payment method until cancellation.

Access to subscription or membership materials is granted only for the duration of an active and fully paid subscription. If a subscription is canceled or payment fails, access to subscription content may be suspended or terminated immediately.

Unless otherwise expressly stated in writing, subscription materials are licensed for access only and may not be downloaded for permanent retention, redistributed, shared, reproduced, or stored beyond the active subscription period.

We reserve the right to modify, suspend, or discontinue subscription offerings, pricing, benefits, or access terms at any time. Continued participation in a subscription program after such modifications constitutes acceptance of the updated terms.
